Terms & Conditions
The agreement between you and Premium FX covering your account, your orders and your money.
1. Who this agreement is with
These terms govern the relationship between you and Premium FX Ltd (“we”, “us”), registration number HE 000000, in respect of the trading account you hold with us and every transaction executed through it.
2. Client classification
We classify you as a retail client unless you have applied for, and we have agreed to, a different classification. Your classification determines the regulatory protections that apply to you, including leverage limits and negative balance protection.
3. Nature of the products
All instruments offered are contracts for difference. You acquire no ownership of, and no rights in, the underlying instrument. CFDs are complex instruments and come with a high risk of losing money rapidly due to leverage.
4. Orders and execution
Orders are executed in accordance with our order execution policy. We may decline an order where doing so is required by law, by our regulatory obligations, or where accepting it would breach a position or exposure limit.
5. Margin
You must maintain sufficient margin at all times. Where your margin level falls below the required minimum we may close positions without further notice, as described on the leverage and margin page.
6. Costs
Spreads, commissions and overnight financing are applied as published on the spreads and commissions page and on the platform. We will give notice of changes as required by our regulatory obligations.
7. Client money
Your funds are held in segregated client accounts at regulated credit institutions, separately from our own money, as described on the regulation page.
8. Withdrawals
Withdrawals are returned to the same method and account from which funds were received, in your own name. We cannot remit funds to a third party.
9. Prohibited conduct
Market abuse, exploitation of erroneous prices, latency arbitrage against a stale feed, and the use of an account by anyone other than the account holder are all prohibited and may result in closure of the account.
10. Liability
We are not liable for losses arising from events outside our reasonable control, including failures of internet connectivity, third-party platforms or data feeds, save to the extent such liability cannot be excluded by law.
11. Complaints and governing law
Complaints are handled under our complaints procedure. This agreement is governed by the law of the jurisdiction stated in your account documentation.
12. Amendment
We may amend these terms, giving you the notice period required by our regulatory obligations. Continuing to use the account after that period constitutes acceptance.
